Based upon the details of the investigation, they will make a recommendation to the full board as to whether the case should be dismissed or if further action by the Board is warranted.
If the Board determines that there is probable cause to believe that there is a violation of GS 89D or NCAC Title 21, Chapter 28, they will issue a Notice of Hearing. If served with a Notice of Hearing, the licensee may file a written response.
If the matter requires a contested case hearing, it will be conducted by a majority of the Board with the Board Chairman serving as presiding officer. If unavailable or disqualified the Vice-Chairman will preside.
If the Board finds that public health, safety, or welfare requires immediate action, a Summary Suspension may be ordered.
No, there is no language in either NCGS 89D nor NCAC Title 21, Chapter 28 that requires a North Carolina Landscape Contractor to comply with an investigation into their license.
